TERMS AND CONDITIONS

Any access or visit to the website www.allu.ro or the use of the Services offered through this Site implies the acceptance of the Terms and Conditions set out in the following, except in the case where for the respective Content there are conditions of use separately formulated or at your disposal another valid user agreement entered into. If you do not agree with the Terms and Conditions set forth in this Document, please do not use this Site.

DEFINITIONS
Customer - The person who has or obtains access to the Content and Service and who has placed at least one Order on the Site;
Account - the set consisting of an e-mail address and a password that allows a single User access to restricted sections of the Site through which access to the Service or the transmission of the Order is made, in which case it contains information about the Customer and the Customer's history in Site (orders, invoices, guarantees, products, returns, etc.);
Content
- any information found on the Site or available in the Service that can be visited, viewed or accessed by the User/Member/Client through an electronic device;
- the content of any communication sent to Users/Members/Clients by Holiv Ecoplant by electronic means and/or any other means of communication available;
- any information communicated by any means by an employee/collaborator of Holiv Ecoplant to Members/Clients according to the contact information specified by him;
- information related to the Products and/or prices applied by Holiv Ecoplant in a certain period;
- information related to the Products, services and/or prices charged by a third party with whom Holiv Ecoplant has concluded partnership contracts, in a certain period;
- data related to Holiv Ecoplant or its other data;
Order – the operation by which the Customer expresses his intention to purchase products sold through the Website by Holiv Ecoplant;
Contract - represents the remote consensual agreement entered into between Holiv Ecoplant and the Client regarding the sale, respectively the purchase, of one or more Products on the Website, by placing an Order by the Client and its acceptance by the Seller, in compliance with the legal provisions and Terms and Conditions;
Document - these Terms and Conditions;
Member - The natural person who has or obtains access to the Content, through any means of communication or based on a user agreement and who requires the creation and use of an Account;
Newsletter - periodical means of information, exclusively electronic, respectively e-mail or other form of remote communication (e-mail, SMS) about the Products and/or the promotions carried out by Holiv Ecoplant in a certain period;
Products - Any goods (products) that are made available to the User by Holiv Ecoplant for purchase, for a fee, by using the Site.
Service - The e-commerce service carried out exclusively on the publicly available sections of the Site, in the sense of granting the possibility for Users to Contract products using exclusively electronic means, including other means of remote communication (telephone). The products offered through this Site are available for delivery in European Union countries.
Website – the www.allu.ro domain and its subdomains.
Specifications – all specifications and/or descriptions of the Products as set out in their description.
User - The natural person who has or obtains access to the Content, through any means of electronic communication, who does not have an Account created and has not placed any order on the Site.
Transaction - the operation of payment, respectively collection, of an amount of money as a result of the sale, respectively purchase, of a Product through the Site.

GENERAL PROVISIONS
Holiv Ecoplant may modify this Document at any time to reflect changes in legislation, internal policies or technology used. Any changes made to the Document will be effective for the Services only for orders registered after the publication of those changes on this Site.
Holiv Ecoplant has the right, at any time, to modify, suspend or terminate the online sale of the Products, partially or totally, temporarily or permanently, with or without prior announcement/notification.
Holiv Ecoplant will make technical efforts to ensure the proper functioning of the Website. In the event that there are interruptions in operation or impossibility of access by Users/Clients/Members for a determined period of time, Holiv Ecoplant will not be liable to any person for any damage or losses suffered, resulting directly or indirectly as a result of improper use of the Service provided, of non-functioning of the Service for technical reasons and/or the action of third parties.
Holiv Ecoplant will perform the necessary diligence to achieve the purpose of the Site and has no responsibility regarding the Content posted by Users within the Services.
Holiv Ecoplant assumes no responsibility and will not be liable for any damage or viruses that may affect your computer or other electronic equipment as a result of accessing or using this Site or downloading any material, information, text, video images or audio from site.
Accessing this Site is done at the user's own risk, Holiv Ecoplant not being in any way responsible for any direct or indirect damages determined by accessing the Site or as a result of making/completing an Order or any use of the data and information on this Site .

RULES OF USE OF THE SITE
It is prohibited to use the Site for the promotion or sale on it of goods or services other than those presented by Holiv Ecoplant.
You may not use the Site to display or transmit any material that is unlawful, abusive, licentious, defamatory, vulgar, inflammatory, threatening, pornographic or profane, or any other material that may constitute or encourage conduct that could give rise to a crime or that could lead to civil liability or would represent a violation of other legal provisions.
You may not access the Site or use the Services in a manner that could damage, disable, overburden, or damage any server or networks connected to any server or that could affect any other User's use of the Services.
Any deletion, addition, insertion, modification of information on the Site, as well as any attempt to gain unauthorized access to the Site, to the accounts of other Users, to connected computer systems or networks or to any other Services by fraud, decoding is prohibited passwords or by any other means, including exploiting a means unintentionally made available by Holiv Ecoplant. INTELLECTUAL AND INDUSTRIAL PROPERTY
The content of the Site, as defined in the preamble, including without limitation all texts and static images, dynamic images and/or multimedia content, buttons, commercial symbols, trademarks and/or designs or commercial models are the exclusive property of Holiv Ecoplant, which is All rights obtained in this regard directly or indirectly (through licenses for use and/or publication) are reserved.

Without the prior written consent of the Operator, any distribution, communication, copying, display, reproduction, publication, licensing, creation of derivative works, transfer or sale of the Content will be considered a violation of the Terms and Conditions, as and the rights enjoyed by the holders of intellectual property rights over the Content.
Users who publish/submit any kind of Content on the Site have the obligation not to infringe the copyright of a third party in any way.

INFORMATION PRESENTED ON THE SITE
All the elements used to describe the Products (such as, but not limited to, static or dynamic images, descriptive text, graphic or video presentations) do not represent a contractual obligation on the part of the Seller, they are used exclusively for presentation and information purposes. For this reason, we request that before placing an Order, you carefully check the characteristics of the Product as presented on the Site.
Holiv Ecoplant makes every effort to ensure the correctness and completeness of the data and information published on the Site, including the description of the Products, as well as the indicated prices. However, the people who use this Site are informed about the possibility of errors. To the extent that it is found that the error affected or, as the case may be, influenced an Order or the concluded Contract, Holiv Ecoplant will inform the Client as soon as possible in order to reconfirm the Order/the validity of the Contract or, possibly, cancel it/them.
The products that are the object of sale within a promotion or campaign of any type will also be subject to the terms and conditions applicable to that campaign or promotion and which will be properly announced in advance. Users/Customers/Members are requested to read the terms and conditions applicable to a particular campaign or promotion before placing an Order for Products that are part of that campaign or promotion.

ONLINE SALES POLICY
Access to the Site in order to place an Order is allowed to any User who acts with a legitimate purpose and who intends to purchase one or more Products from the Seller, in compliance with this Document.
Orders on the Site can only be made by persons who have reached the age of 18 on the date of placing the Order and want the delivery of the Products to take place on the territory of the European Union.
There is no minimum value for placing an order on the Site.
Holiv Ecoplant markets the Products online in an en-retail system (retail trade), not intended for resale or distribution for commercial purposes.
Holiv Ecoplant reserves the right to deny access to some Users/Members/Customers to part or all of the functions related to online trading, as well as to restrict the processing and/or delivery of an Order if there are suspicions of fraud on their part or if he has a behavior that may harm the interests of Holiv Ecoplant.
Posting opinions about products or communicating with Holiv Ecoplant can be done by using the data mentioned in the "Contact" section of the Site. Opinions or addresses containing insults or inappropriate language will be removed from the Site or ignored, Holiv Ecoplant having the freedom to manage the information received without having to justify its actions.

THE ACCOUNT
In order to purchase a Product, you must have an Account.
The account is created either voluntarily, by filling in the mandatory fields with the requested personal data - e-mail address and password, or by our operator - on your behalf, when you prefer to order products by phone, our operator will take over and enter personal data in Account.
The account can also be created through a social network (e.g. Facebook, Gmail) your authentication data (email address and password) will be imported from the existing account on these networks.

If you are not a consumer (but a representative of a legal entity) and you order products for a legal entity that you represent and on whose behalf you act, it will be necessary to provide us with additional information about this entity (name, registered office, registration number, tax identification code). In any communication with us on behalf of the legal entity you represent, you will act on its behalf and legally bind that entity.
Following the creation of the Account, the Customer will receive an Account confirmation link on the indicated e-mail address, which must be accessed by the Customer to complete the registration procedure.

COMMAND
In order to purchase Products, you can submit an Order to us by following the ordering process on the website or by phone.
The order through the Website is made through the following steps:
(i) Selecting the Product/Products and adding them to the shopping cart by pressing the "Add to Cart" button.
(ii) Pressing the "Complete order" button, then a page will open for logging into the Account or entering personal data, if you are not already logged in with the account or do not have the data entered - name, surname, email address, phone contact, those regarding the billing and delivery address, the desired payment method, the application of possible discounts as a result of having a voucher code, discount code or gift card, ticking the "I agree with the Terms and Conditions" box, expressing or not the agreement for the receipt of the Newsletter and the method of receipt.
(iii) Sending the order to Holiv Ecoplant.
The customer must ensure that the order data and the delivery and contact information provided are correct. During the ordering process, before submitting the order you can check, modify or correct any errors, review the list of ordered products.
Adding a Product to the shopping cart, in the absence of completing the Order, does not entail the registration of that Order, implicitly neither the automatic reservation of the Product.
The order represents your offer to purchase the products, subject to confirmation by Holiv Ecoplant.
After placing the Order, the Customer will receive a notification message by e-mail regarding the registration of the Order. Also, the notification regarding the registration of the Order will include the order number (assigned to each order) in the Holiv Ecoplant system, the details of the Products ordered, the total price of the Order, including delivery costs. The notification received by the Customer after placing the Order regarding the taking over of that Order is informative and does not represent acceptance of the Order by us.
After checking the stock of Products, Holiv Ecoplant confirms by e-mail the availability of the ordered Products, the delivery term and, respectively, the acceptance of the Order. The acceptance of the Order signifies the conclusion of the contract between you and Holiv Ecoplant, the provisions of this Document as well as any subsequent agreements entered into between the Customer and Holiv Ecoplant regarding an Order, regardless of whether or not they are contained in an electronic or physical document, are part of the Contract .
The order can also be placed over the phone - providing our operator with the necessary data to open a user account on your behalf, including an email address through which your order can be accepted and confirmed. This email will also contain links to the Processing of Personal Data and this Document which we invite you to study. Acceptance of the order and, respectively, the existence of a contract between you and us is implicit and proven by the recording of the telephone conversation.
If we are unable to send the order placed on www.allu.ro through the courier company chosen by you (technical reasons, increased volume that would lead to an increase in time), we reserve the right to send the order, with a different courier company than the one selected on the checkout page.
Holiv Ecoplant can cancel the Order launched by the Customer, with the simultaneous or subsequent notification of the Customer, without being liable for such an action, in the following cases:
(i) non-acceptance by the issuing bank of the Customer's card, of the Transaction, in the case of online payment;
(ii) the invalidation of the Transaction by the card processor approved by Holiv Ecoplant, in the case of online payment;
(iii) the data provided by the Customer on the Site are incomplete and/or incorrect;
(iv) the Customer's express request to cancel the Order, expressed in writing;
(v) the technical impossibility of processing the Order at the level of the Site, for reasons independent of the Seller;
(vi) any of the terms and conditions in this document have not been properly observed by the Client.

DELIVERY. TRANSFER OF OWNERSHIP AND RISKS
Products are delivered by courier anywhere in the European Union.
The delivery deadline is indicated in the Order acceptance email, respectively within 2-3 working days, without exceeding the deadline of 14 days.
The customer will be able to fill in a single delivery address in the order form, for each order placed.
Ownership and risks on the Products will be transferred upon delivery, but subject to payment by the Customer.
We do not accept responsibility for any losses that may occur due to delivery delays – if these are caused by circumstances beyond our control or in respect of which we could not take reasonable steps to prevent the delay (government actions, force majeure impediments, wars, acts of terrorism, protests, uprisings, civil disturbances, fires, explosions, floods, epidemics, strikes.)
If the product cannot be delivered, Holiv Ecoplant undertakes to inform the Customer of this unavailability, and the amounts paid in advance to be reimbursed within a maximum of 30 days.
The maximum amount of damages that can be paid by Holiv Ecoplant to any Customer in case of non-delivery or improper delivery is the amount collected by Holiv Ecoplant from this Customer.
If the customer shows bad will by repeated refusals of the parcels, we reserve the right to refuse to ship the orders.

BILLING AND PAYMENT
The price of the Products is the one mentioned on the Site and includes VAT at the rate applicable according to the legislation in force.
The delivery cost is charged in addition to the price of the products. The delivery of the Products will be for a fee or free of charge, depending on the conditions applicable to the Order or the campaign carried out by Holiv Ecoplant on the date of the Order.
The ordered products can be paid in cash, in the local currency, upon delivery (cash on delivery), online - with the card through the platform available on the Site.
Also, the Order can be partially or fully paid with a gift card or voucher issued by Holiv Ecoplant.
The payment card data will not be accessible to Holiv Ecoplant nor will it be stored by Holiv Ecoplant, but only by the payment processor integrated into the Site and by the Transaction authorization institution or another entity authorized to provide storage services of the card identification data, about whose identity the Client/User/Buyer will be informed, prior to entering the data.
We make every effort to ensure that the Price stated on the Site is correct and complete. In the event that we discover an error, we are not obliged to supply you with that product at the wrongly stated price, and will refund any amount already collected in the absence of your agreement to purchase the Product at the correct price.
The Seller will issue an invoice to the Customer for the delivered Products, and the Customer is obliged to provide all the information necessary to issue the invoice according to the legislation in force.
The Seller will send the Customer the invoice related to the Product Order, as well as for any other costs related to the Order, in physical or electronic format, by including the invoice in the package containing the delivered Products, respectively by e-mail, to the address mentioned by the Customer.

PRODUCT CONFORMITY AND WARRANTIES
If you are a consumer, and on Delivery you find that a product does not correspond to your Order (accepted and confirmed by us according to this Document), you can ask us to replace it without any payment from you, within 15 calendar days from when you informed us (if the replacement applies to that type of product and is possible) or refund the price you paid (provided you return the product to us at our expense - when we ask you to do so).

The warranty provided does not affect your other rights established by applicable law.
If you are not a consumer: you must check all products as soon as you receive them and, within 5 working days of delivery, inform us in writing of any non-conformity of the products. If we do not receive such information from you within the indicated period, the products will be considered accepted by you and you will no longer be able to invoke their non-conformities (such as apparent defects, hidden defects or other deficiencies, etc.).

RIGHT OF UNILATERAL TERMINATION (WITHDRAWAL)
If you place an Order through the Website, you can cancel the Order at any time before the conclusion of the Contract, according to the present Terms and Conditions.
The consumer also has the right to unilaterally terminate the Contract within 14 days from the physical delivery of the Product, without having to justify the withdrawal decision and without incurring other costs than those established by law. If you have ordered several products in one order that will be delivered separately, the term expires after 14 calendar days from when you took physical possession of the last product.
To exercise the right of withdrawal, the Customer will cumulatively fulfill the following obligations:
(i) will send to Holiv Ecoplant within 14 days his decision to withdraw from the Contract either using any unequivocal statement expressing his decision to withdraw from the Contract, which he will send by email to office@allu.ro.
(ii) will return the Product in respect of which it withdraws from the Contract to Holiv Ecoplant at the address: Eriu Sâncrai locality, Craidorolț commune, no. 392, Satu Mare county, as soon as possible.
Holiv Ecoplant can provide coverage of all shipping costs for returned products (regardless of the reason for the return) as well as the loyalty procedure if the return is requested and processed through the existing section in the Account.
If the Order is paid, Holiv Ecoplant will refund the amount paid by you, within a maximum of 14 (fourteen) days from the date of notification by the Buyer of his decision to withdraw from the Contract, only by bank transfer to the account from which it was payment made.
Holiv Ecoplant will be able to delay refunding the amount until receipt of the goods sold or until receipt of proof that they have been dispatched, if it has not offered to retrieve the Goods itself (the latest date will be taken).
In the case of a decrease in the value of the products - due to the way you handled or used them (other than to determine the nature, qualities and functioning of the products) we will be able to partially refund you the amount we collected from you, being able to reduce the counter value the reduction of the respective products.
Holiv Ecoplant reserves the right not to accept withdrawal from the contract if, upon returning the products, it is found that they are not in the condition in which they were delivered (contain traces of use, missing labels, emblems, other safety elements or components ).
Products that, by their nature, cannot be returned or that can degrade or deteriorate quickly cannot be withdrawn from the contract.

CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA
Holiv Ecoplant will ensure the confidentiality of all data provided for the purpose of creating the Account and delivering the Services.
You have the obligation to communicate to us as soon as possible if you have any indications or suspicions that a third party may affect the security of your Account. PROMOTION OF PRODUCTS AND OFFERS
To promote the Products and available offers, Holiv Ecoplant can send Newsletters.
To the User/Customer/Member who opted to receive them, directly or through commercial partners, with the assurance/respect of confidentiality regarding the data provided by the User/Customer, by various means, such as by e-mail, any other electronic means equivalent communication (such as SMS etc.)
The User/Client/Member has the right to opt-out at any time of the option initially expressed as follows:
(i) Using the specially intended link within any newsletters and/or alerts received;
(ii) By modifying the acceptance or to receive newsletters and/or alerts and by using pages from restricted areas, by using the Account.
(iii) By contacting Holiv Ecoplant, according to the contact information available on the Site.

LIABILITY
Holiv Ecoplant cannot be responsible for damages of any kind that the Customer or any third party may suffer as a result of Holiv Ecoplant fulfilling any of its obligations under the Order and for damages resulting from the use of the Products after delivery and in particular for their loss.
However, to the extent that the limitation of liability according to the above is not possible, the extent of Holiv Ecoplant's liability for any damage caused will only extend to the competition of the counter value of the Products that were the subject of the Order on the basis of which the causative act was generated by damages.
The Customer is responsible for the safe keeping of the Account details, being solely responsible for the fraudulent use of these details as a result of their transmission to a third party willingly or as a result of their fault.

REPORTS / COMPLAINTS
For notifications or complaints related to this Document, the Client has at his disposal the contact form on the Website. Complaints will be analyzed within 10 days of their receipt, and the Client will be notified of an answer immediately after their resolution.

APPLICABLE LAW
This Document is governed by Romanian law in force.
In the event of any disputes regarding this Document, an attempt will be made to resolve them amicably via the email address office@allu.ro, and if amicable resolution is not possible, the dispute will be resolved by the courts authorities from Romania.
In the same sense, if the transaction between you and us was concluded through the website, in accordance with Regulation (EU) no. 524/2013, we inform you that you have the right to request the settlement of the dispute out of court, through the online dispute resolution platform, accessible at the Internet address:
